In monitoring the D.O.J. publications, I noticed an announcment about the Manhattan Law firm that was found guilty of conspiracy to commit immigration fraud.I remember that one of this forum's contributers had a special interest in this type of crime. In this case, an FBI Agent posed as an Albanian immigrant, and was instructed to fabricate a personal history of persecution for his application for political asylum. Since my location has a heavy concentration of immigrants, I'm wondering which section of INS/ICE would administer a polygraph examination, if one is required? Do they have their own examiners or do they contract out? IP: Logged |

I have a special interest in this matter. In the next future I should poly inmigrants in order to detect colombian terrorist subjects posing as "innocent inmigrants". The only polygraph component within Homeland Security that covers immigration matters is Customs and Border Protection, Office of Internal Affairs. The unit is run by John Schwartz (former DODPI instructor) His unit generally conducts pre-employment exams for immigration and border patrol agents. Occasionally they will work criminal cases involving immigration and public corruption cases. There is no one exclusive unit dedicated to immigration fraud/issues. Pat Coffey out of San Francisco has started a program called I-CARE that focuses on assisting asylum refugees resolve conflicting immigration issues under review by the immigration court system (totally separate from the federal court system).Did I create more questions than answers? Hi Patrick Coffey here. In regard to the testing for Asylum and other Immigration issues; there are over 60,000.00 Asylum claims filed each year. The rejection rate is about 70% on them, and Immigration law firms find themselves under investigation as to whether they are in collusion with their clientelle in the filing of false stories on such claims. The case examples I have seen have primarily been where the Immigration attorney is of the same ethnicity as the Asylee, but not always. Lawyers have been rightly disbarred, prosecuted, and convicted if and when they do such activity. The goal of I-CARE / Immigration Credibility Assessment Registered Examiners as an organization has been to assist those who are the Truthful as Asylees, and for Immigration Attorneys to be able to insulate their law practices from such fraud by in fact turning to outside experts. Further, that by using standardized methods we would bring great credibility to the PDD community in this new area, and which historically allows for testimoney under 702 in U.S. Immigration court as I have done for a legal class of Truthful persons in need of such case enhancement.
